RE: The tariff classification of eight embroidered motif emblems (patches), to be affixed to various garments, from either Thailand, Indonesia or China.

Dear Ms. McDaniel:

In your letter dated April 12, 2000, on behalf of Fraje, Ltd., Seattle, WA, you requested a classification ruling.

Eight representative samples were submitted, which were identified as 1(A), 2(A), 2(B), 3 (A), (B), (C), (D) and (E)

The first item, identified as 1(A), consists of a round patch measuring about 2" in diameter which consists of 100% polyester thread embroidery in the form of a design over a ground fabric. This embroidery also forms a hem over its felt backing.

Samples 2(A) & (B) both consist of similar embroidered patches, except, perhaps, for the construction of the ground fabrics (one is round and the other is rectangular). They consist, essentially, of polyester thread embroidery in the form of a design over a visible ground fabric. Samples 1(A), 2(A) & (B) are all designed to be sewn on to various garments and are available in many other designs.

Samples 3 (A), (B), (C), (D) and (E) all consist of 100% polyester thread embroidery over a 100% polyester ground fabric. The thread embroidery completely covers the ground or backing fabrics. These five patches or emblems are all backed with a plastics substance to facilitate their ultimately being heat sealed on to various apparel items.

The applicable subheading for all eight motifs (patches) will be 5810.92.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for other embroidery, ..., in motifs, with visible ground, of man-made fibers, badges, emblems and motifs. The rate of duty will be 5.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
