RE: The tariff classification of a woman’s cardigan and vest from Hong Kong

Dear Mr. Imbrogulio:

This is a replacement letter for New York Ruling Letter (NYRL) NY F83548 that was issued to you on March 23, 2000. You state in your letter dated March 30, 2000, that a typographical error was made regarding the style number (5MiL52905) and that the correct style number is 5ML52905. Please see correction below.

In your letter dated February 29, 2000, you requested a tariff classification ruling.

You submitted two samples. Style number 3BW52910, is a woman’s cardigan that is constructed from 100% wool, knit fabric. The outer surface of the fabric measures more than 9 stitches per 2 centimeters in the horizontal direction. The cardigan features stand-up collar; long sleeves; a full front opening with a zipper closure; and 2 sideseam patch pockets in the waist area.

Style number 5ML52905 is a woman’s vest composed of a leather front and a textile back. The garment has a leather stand-up collar and yoke with 2 zippered pockets below the waist and a full front zippered closure.

The applicable subheading for the cardigan, will be 6110.10.2080, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s cardigans, knitted: of wool or fine animal hair: other. The duty rate will be 16.4% ad valorem.

The applicable subheading for the vest will be 4203.10.4095, which provides for articles of apparel, of leather or composition leather: articles of apparel: other, other: women’s, girls’ and infants.

The cardigan falls within textile category designation 438. Based upon international textile trade agreements the cardigan from Hong Kong is subject to quota and the requirement of a visa. The vest is not subject to quota nor visa requirements.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
