RE: The tariff classification of a stuffed toy from China.

Dear Ms. Pulisciano:

In your letter dated March 27, 2000, you requested a tariff classification ruling, on behalf of Maine Patchwork.

You are requesting the tariff classification on a stuffed animal toy, specifically a stuffed toy moose. The toy is constructed of textile materials stated to be: 65% acrylic and 35% polyester. The toy is completely stuffed with traditional textile materials and is therefore classified in the provision for stuffed toys in the Harmonized Tariff Schedule of the United States (HTSUS). The toy moose is blue and pink in color, is designed in a sitting position and has an amusing appearance.

The applicable subheading for the stuffed toy animal (moose) will be 9503.41.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for “Toys representing animals or non-human creaturesand parts and accessories thereof: Stuffed toys and parts and accessories thereofStuffed toys.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
