RE: The tariff classification of three fusible interlining materials which will be used for fusing into jackets, from Germany.

Dear Ms. Woods:

In your letter dated February 22, 2000, on behalf of Kufner Textile Corporation, Simpsonville, SC, you requested a classification ruling.

Three representative samples were submitted.

The first item, style B131N57, and white in color, consists of a polyester man-made fiber woven fabric that has been coated on one surface with an application of thermoplastic resin dots (52 dots/cm²) which are composed of a polyamide plastics material.

The second item, style B133N57, and black in color, consists of a polyester man-made fiber woven fabric that has been coated on one surface with an application of thermoplastic resin dots (52 dots/cm²) which are composed of a polyamide plastics material.

The third and final item, style B134N57, and gray in color, consists of a polyester man-made fiber woven fabric that has been coated on one surface with an application of thermoplastic resin dots (52 dots/cm²) which are composed of a polyamide plastics material.

With respect to all three samples, while the “dots” are small “points” of clear polyamide thermoplastic resin, they are visible to the naked eye. You provided the following specifications for this group identified as the B 130 Series:

Product weight: 2.19 ounces per square yard (73 g/m²) Warp: 100% textured polyester yarn
Weft: 100% textured polyester yarn
Available in 60 and 66” widths

The applicable subheading for the three materials will be 5903.90.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, of man-made fibers, not over 70 percent by weight of rubber or plastics. The duty rate will be 7.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
