RE: The tariff classification of fabric wall hangings from China.

Dear Ms. Pearson:

In your letter dated February 16, 2000, you requested a classification ruling.

You have submitted three samples of banner wall hangings. All of the wall hangings have wood dowels inserted at the top and bottom. A gold cord is attached to the top dowel for hanging. The banners are composed of 90 percent acrylic and 10 percent wood. Each banner measures 18” long by 8.5” wide.

Item #62746 is a textile wall hanging banner. The decorations on the banner consists of the words “Felices Fiesta” and the picture of a pinata.

Item #62745 is a textile wall hanging banner with the words “Prospero Ano Nuevo” (Happy New Year) and a picture of a sky rocket and stars.

Item #62632 is a textile wall hanging banner with the words “Feliz Navidad” and the picture is the silhouette of Bethlehem.

The applicable subheading for item #62746 will be 6304.93.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of synthetic fibers. The duty rate will be 9.8 percent ad valorem.

The wall hanging falls within textile category designation 666. Based upon international textile trade agreements products of China are subject to the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

The applicable subheading for item #62745 will be 9505.90.4000, HTS, which provides for festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Confetti, paper spirals or streamers, party favors and noisemakers; parts and accessories thereof. The duty rate will be free.

The applicable subheading for item #62632 will be 9505.10.2500, HTS, which provides forarticles for Christmas festivities and parts and accessories thereof: Christmas ornaments: other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
