RE: The tariff classification of food warmers and sterilizers from the United Kingdom

Dear Mr. Egan:

In your letter dated February 1, 2000, on behalf of Avent Corporation of America, you requested a tariff classification ruling.

The samples you provided are the Avent Bottle & Baby Food Warmer (item 105), the Avent Electric Steam Sterilizer (item 107) and the Avent Microwave Steam Sterilizer (item 108). The Food Warmer and the Electric Sterilizer are electrothermic appliances intended to aid in the preparation of baby food in the home. The Avent Microwave Steam Sterilizer is a covered dish of plastic with two baby bottles. The parent would put water on the bottom of the dish and place the bottles in it. Heating in a microwave oven creates the steam that sterilizes the bottles.

The applicable subheading for the Food Warmer and Electric Sterilizer will be 8516.79.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electrothermic appliances of a kind used for domestic purposes, other electrothermic appliances, other. The rate of duty will be 2.7 percent ad valorem.

The applicable subheading for the dish and cover of the Microwave Steam Sterilizer will be 3924.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles and toilet articles, of plastics, tableware and kitchenware, other. The rate of duty will be 3.4 percent ad valorem.

The applicable subheading for the bottles will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles and toilet articles, of plastics, other, other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
