RE: The tariff classification of a zippered travel bag from Korea.

Dear Ms. Goldfischer:

In your letter dated December 13, 1999, on behalf of American Eagle Outfitters, Inc./Value City Imports, you requested a tariff classification ruling for a zippered travel bag.

The sample submitted, identified as style AEP.20.0119, is a zippered bag similar to a travel/ toiletry bag manufactured of clear polyvinyl chloride (PVC) plastic designed to contain personal effects during travel. The use for the bag will be to contain swimwear during travel. The front of the bag is printed with the words “American Eagle Outfitters Swimwear”. The bag is unlined and measures approximately 7 ¾” x 5 ½” x 1”. The button corners have grommet type vents which permit the contents to “breath”. Your sample is being returned as requested.

The applicable subheading for the travel bag of plastic will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic or of textile materials, other. The rate of duty will be 20 percent ad valorem. The rate of duty for the year 2000 will remain the same.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
