RE: The tariff classification of a Stainless Steel Plate from China

Dear Mr. Sarmiento:

In your letter dated December 10, 1999 you requested a tariff classification ruling on behalf of your client Abco Metals Inc.

You submitted a sample, specification sheet (drawing), and chemical analysis of a Stainless Steel Plate used for the manufacture of a brush guard on pickup trucks. You indicate that this part is an automotive after market item to be used on the front of a pickup truck. The part is not attached to the truck itself but is attached to the front bumper assembly - steel to steel. This bumper guard is not a part of the body or of the front bumper assembly.

The applicable subheading for the Stainless Steel Plate will be 8708.99.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of the motor vehicles of headings 8701 to 8705: Other parts and accessories: Other: Other: Other: OtherOther. The rate of duty will be 2.5% ad valorem.

This rate of duty will remain unchanged in the year 2000.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
