RE: The tariff classification of screws from China, Taiwan and Thailand.

Dear Mr. Zapata:

In your letter dated October 21, 1999, on behalf of your client American Eagle International Inc., Northvale, NJ, you requested a tariff classification ruling .

You stated that the samples are “two drywall screws and one metal to metal screw.” They are all made of iron or steel and are less than 6mm in diameter. One drywall screw has a cross recessed bugle head. The second drywall screw has a square recessed oval countersunk head. The metal to metal screw has a hexagon washer head with a drill-type point. All of the screws have cutting threads and will be made in China, Taiwan and Thailand.

The applicable subheading for all of your items will be 7318.14.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers, (including spring washers) and similar articles of iron or steel: threaded articles: self tapping screws: having shanks or threads with a diameter of less than 6 mm: other. The duty rate will be 6.2% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
