RE: The tariff classification of a neck wrap shell, a body wrap shell and a herb pouch liner from China.

Dear Mr. Vaccaro:

In your letter dated October 18, 1999, on behalf of Wellness Sercrets D/B/A, Global Caravan, Brooklyn, New York, you requested a tariff classification ruling.

The samples submitted are a neck wrap shell, a body wrap shell and an herb pouch liner. The item marked number 1 is a U-shaped neck wrap shell. It is made of three textile fabric panels. The panels will be made of either 100 percent cotton or 22 percent silk/78 percent cotton brushed woven fabric. The panels are sewn together to form the neck wrap shell. It is sewn closed on all sides and features an opening on one side. Sewn around the edges is a textile woven fabric binding.

The item marked number 2 is a rectangular shaped body wrap shell used to hold the herb liner that is filled with herbs.. It is constructed of two textile fabric panels that will be made of either 100 percent cotton or 22 percent silk/78 percent cotton woven brushed fabric. The panels are sewn close on all sides. The center of one side has an opening for the herb pouch to be inserted after importation into the United States.

The item marked number 3 is a rectangular shape herb pouch liner used as the inner lining for the body wrap. It is made of two textile fabric panels, which will be made of either knit fabric or 100 percent cotton woven fabric. The panels are sewn together on all sides except for small openings that have been left unsewn to facilitate the filling of herbs into the article after importation. There are horizontal and vertical stitching throughout the article to create compartments.

The applicable subheading for the neck wrap shell, the body wrap shell and the herb pouch liner will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
