RE: The tariff classification of lamps from China.

Dear Ms. Da Rocha:

In your letter dated October 19, 1999, on behalf of Tristar Products, you requested a tariff classification ruling. Sample is being returned as requested.

The sample submitted is a round-shaped all-purpose battery-operated plastic lamp, referred to as the “Tap Light,” which measures approximately 5 ½ inches in diameter by 2 inches high. This lamp, which can be used on the night table, wall, stairway, outdoor pathway and the like, possesses a convex-like frontal exterior that is designed to be depressed for turning the light on and off.

The applicable subheading for the “Tap Light” will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings, other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
