RE: The tariff classification of the “FOD Boss Rapid Response Sweeper” from Australia.

Dear Mr. Chaplin:

In your letter dated October 4, 1999, you requested a tariff classification ruling.

The submitted literature depicts the FOD Boss Rapid Response Sweeper consisting of a brush sweeper with a Pintle Hook Adapter or a Duplex Hitch Bar. The brush sweeper operates like a large push broom with its own dust pans attached to it. Five rows of bristles and scoops use the friction of the bristles being pulled along to “activate” debris by kinetic energy in the same way as any push broom. The scoops then act like dustpans and pick up the activated debris. It is usually towed by a vehicle, but in some instances it is pulled by a person on foot to get under and around aircraft and other equipment. The brush sweeper sweeps a path 8 feet wide and can pick up rivets, nails, nuts, bolts, luggage hardware, rocks, sand, gravel, etc. It is stored in a carry bag 8 feet 4 inches long by 12 inches wide and weighs 62 pounds. The pintle hook adapter hitch allows the brush sweeper to be towed by military vehicles. The duplex hitch bar allows two brush sweepers to be operated side by side. The hitches are parts which are suitable for use solely or principally with the brush sweeper and will be classified with the brush sweeper.

The applicable subheading for the FOD Boss Rapid Response Sweeper with Pintle Hook Adapter and Duplex Hitch Bar will be 9603.90.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for brooms, brushes (including brushes constituting parts of machines, appliances or vehicles), hand-operated mechanical floor sweepers, not motorized, mops and feather dusters; prepared knots and tufts for broom or brush making; paint pads and rollers; squeegees (other than roller squeegees): other: other, other. The rate of duty will be 2.8% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
