RE: The tariff classification of infants’ wear for boys from Thailand

In your letter dated October 7, 1999 you requested a classification ruling.

Three of the submitted styles, PPS0050B, PPS0050C, and PPS0050D, are manufactured from finely knitted fabric of 55% cotton and 45% polyester. Each style consists of a pair of elasticized shorts and a separate garment for the upper body. The upper body garment of the latter style is a short-sleeved, buttoned shirt. The other two upper body garments are short-sleeved pullovers.

The fourth style, PPS0050A, consists of an elasticized pair of woven shorts, which will be manufactured from 65% polyester and 35% cotton upon importation; and a short-sleeved, pullover shirt, manufactured from finely knitted fabric of 55% cotton and 45% polyester, which buttons at the back.

As you have requested, the sample garments are being returned.

The applicable subheading for the shirt of style PPS0050A will be 6111.20.6030, Harmonized Tariff Schedule of the United States (HTS), which provides for babies’ garments and clothing accessories, knittedof cotton, other, other, other: imported as parts of sets; and the subheading for the shorts of this style will be 6209.30.3030, which provides for babies’ garments and clothing accessories, of synthetic fibers, other, other: imported as parts of sets. The duty rate for the shirt of this style is 8.4 per cent ad valorem, and for the shorts is 16.5 per cent ad valorem.

The applicable subheading for the other styles will be 6111.20.6020, Harmonized Tariff Schedule of the United States (HTS), which provides for babies’ garments and clothing accessories, knittedof cotton, other, other, sets. The duty rate is 8.4 per cent ad valorem.

All of the styles fall within textile category designation 239. Based upon international textile trade agreements products of Thailand are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
