RE: The tariff classification of a glass ashtray from Mexico

Dear Mr. Wortman:

In your letter dated October 12, 1999, on behalf of your client, W.C. Newman & Company, you requested a tariff classification ruling. A representative sample of the item was submitted and will be returned to you as requested.

The subject article (style 770) is a glass ashtray measuring four and one-half inches in diameter by one and three-sixteenths of an inch in depth. The item features a raised lip with twenty-four evenly spaced indentations. The indentations in the item are designed to hold cigarettes in place.

You stated in your letter that this article will be sold to commercial entities such as hotels and restaurants, which use this glassware solely as ashtrays.

The applicable subheading for the glass ashtray (style 770) will be 7013.99.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes: other glassware: other: other: smokers’ articles. The rate of duty will be 9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
