Dear Ms. Mossa:

In your letter dated September 21, 1999, you requested a classification ruling.

The samples submitted with your request are identified as style numbers 101, CD player case; 103, CD wallet/holder; and 105, valuables bag. Each item is constructed of an exterior surface of nylon textile material. The CD player case measures 6 1/4" x 5 1/4" and consists of two separate zippered compartments. A strip of nylon webbing is inserted through loop holders on the rear of the case that enables the user to wear the item around one's waist. The CD holder measures 6 1/2" x 6 1/2" and is designed to hold 12 CDs. The holder is secured by a zip around closure and a carry handle is permanently attached to the side of the case. The valuables bag is a generic utility pouch with an open front pocket that measures approximately 6 1/4" x 6 1/4". The top opening of the pouch is secured by a hook and loop closure. A dog leash type clasp is affixed to a loop of nylon webbing sewn into the upper side exterior of the pouch.

The applicable subheading for style #101 and 103 will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides for gun cases, holsters, and similar containerswith an outer surface of textile materials, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

Items classifiable under HTS subheadings 4202.92.9026 and 4202.92.3031 fall within textile category designation 670. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

Your samples are being returned as requested.

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Kevin Gorman at 212-637-7091.
