RE: The tariff classification of a ladies’ garment from Hong Kong.

Dear Ms. Johnson:

In your letter dated October 7, 1999, you requested a tariff classification ruling. The provided sample will be returned as per your request.

Style S319004 is a long line brassiere approximately 9 ¾ inches in length from the top of the cups to the hemmed bottom. A knitted mesh 85% nylon 15% spandex fabric comprises the form fitted underwire cups and the center front portion of the garment which measures approximately 4 inches across. The balance of the garment is constructed of a 65% cotton 30% nylon 5% spandex twill fabric. The brassiere features 5 vertical stays measuring approximately 4 inches in length, adjustable shoulder straps, and 9 front brassiere type hook and eye closures. The essential character of the brassiere is imparted by the twill fabric.

The applicable subheading for style S319004 will be 6212.10.9010, Harmonized Tariff Schedule of the United States (HTS), which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassieres: other: other . . . of cotton. The rate of duty will be 17.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
