RE: The tariff classification of clad steel plate from France.

Dear Ms. Lowy:

In your letter dated September 3, 1999 on behalf of Creusot-Loire, you requested a tariff classification ruling.

The products to be imported are clad steel plates consisting of a carbon steel substrate and a nickel cladding material that are matched together to form a composite assembly and then heated and rolled so that the two metals become metallurgically bonded. The plates typically measure 5/16 inch in thickness (1/4 inch carbon steel and 1/16 inch nickel), 120 inches in width and 285 inches in length. The clad plates will ultimately be used as chimney liners.

The applicable subheading for the clad steel plates will be 7210.90.10, Harmonized Tariff Schedule of the United States (HTS), which provides for flat-rolled products of iron or nonalloy steel, of a width of 600 mm or more, clad, plated or coated, other, clad. The rate of duty will be 3.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
