RE: The tariff classification of motor flushers from Taiwan.

Dear Ms. Loszack:

In your letter dated September 23, 1999, on behalf of Tempo Products Co., you requested a tariff classification ruling.

Two samples (1962RMF and 1964PMF) were provided with your letter. The motor flushers consist of two cups of natural rubber, approximately rectangular, affixed to a metal wire rod constructed for a spring-like action. Model 1962RMF also has a plastic sleeve and hose fitting to which a hose can later be attached. Model 1964PMF will be imported incomplete and the plastic sleeve and hose fitting will be attached after importation. The cost breakdown provided in your letter indicates that the rubber cups are almost three times the value of the wire rod and more than four times the value of the plastic components. The motor flushers are used to secure a water hose to a marine engine so that sand, silt, salt and alkali may be flushed out. As you requested, the samples are being returned.

The applicable subheading for the rectangular cups will be 4016.99.3500, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of vulcanized rubber other than hard rubber, of natural rubber, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
