RE: The tariff classification of storage pockets and storage bags from China.

Dear Ms. Klingbeil:

In your letter dated September 27, 1999, you requested a classification ruling.

The samples submitted were two “Karo Storage Pockets”, item numbers 80018567 and 60018568. Also submitted are “Viggor Storage Bags”, item number 40018569. Item number 80018567 is made of five pieces of 100 percent cotton canvas panels sewn together to form a pocket. It features a flip top closure that is held closed with strips similar to the VELCRO brand fastener. Sewn into the top edge of the back panel is a plastic rod. Attached onto the exterior top are two textile straps, with the same above strips, and a braided textile cord to allow the article to hang from a chair. The article measures approximately 13” x 10-1/2”.

Item number 60018568 is constructed of two textile fabric panels. One panel is made of 100 percent cotton canvas fabric and the other is constructed of a woven fabric with plastic dots on the exterior side. Lengthwise the panels are sewn together and attached at each end is a pocket designed with a flip top closure that is held closed with strips similar to the VELCRO brand fastener. Attached onto the top of the pocket is a braided textile cord. Sewn into the top edge of the back panel is a plastic rod. The article is designed for throwing over a bench so that the pockets hang down the side.

Item number 40018569 consist of four bags made of 100 percent polyester woven fabric panel. The panel for each bag is folded in half and sewn closed on the two sides. The top opening has a braided textile drawstring closure. The bags measure approximately 15” x 10-1/2”, 12-1/2” x 8-13/16” 9-3/4” x 7” and 10” x 4”.

The applicable subheading for the two “Karo Storage Bags will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles . . . Other. The duty rate will be 7 percent ad valorem.

The applicable subheading for the “Viggor Storage Bags” will be 4202.92.3031, HTS, which provides for travel, sports and similar bags: With outer surface of textile materials: Other, Other: Of man-made fibers: Other. The duty rate will be 18.8 percent ad valorem.

The “Viggor Storage Bags” falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
