RE: The tariff classification of smoked salmon from Chile.

Dear Mr. Flegenheimer:

In your letter, dated September 16, 1999, you have requested a tariff classification ruling on behalf of your client, Professional Food Source LLC, Seattle, WA.

The merchandise is frozen, smoked, sliced salmon (salmo salar).

The applicable subheading for smoked salmon will be 0305.41.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for fish, dried, salted or in brine; smoked fish, whether or not cooked before or during the smoking process; flours, meals and pellets of fish, fit for human consumption, smoked fish, including fillets, Pacific salmon (Oncorhynchus nerka, Oncorhynchus gorbuscha, Oncorhynchus keta, Oncorhynchus tschawytscha, Oncorhynchus kisutch, Oncorhynchus masou and Oncorhynchus rhodurus), Atlantic salmon (Salmo salar) and Danube salmon (Hucho hucho). The rate of duty will be 5 percent ad valorem.

In your correspondence you inquire as to the GSP applicability of salmon from Chile. Subheading 0305.41.0000, HTS, is annotated for GSP in the Special Rates of Duty column with the symbol "A+." This symbol indicates that preferential duty treatment under this subheading is extended only to countries designated as "least developed developing countries." General Note 4(b)(i), HTSUSA, contains a list of countries designated as "least developed developing countries." Chile is not included in this listing and, therefore, is not eligible for preferential duty treatment under the Generalized System of Preferences.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
