RE: The tariff classification of plastic figurines from China.

Dear Ms. Cross:

In your letter dated August 30, 1999, on behalf of your client Grolier Collectibles, you requested a classification ruling.

You have submitted two samples of plastic figurines.

The first sample is a figurine that is identified as favorite friends. This plastic article is called “Gone Fishin”. The figurine is designed with the Disney cartoon characters Mickey and Pluto sitting in a boat, fishing. The base of the figurine is made to appear as if the boat is in the water.

The second sample is identified as alphabet fun blocks. It is designed with a mermaid sitting on top of a block. The block has the capital letters of the alphabet on the front and the small letters on the back. This article is made of plastic.

These products are claimed to be collectible statuettes made of plastics.

The applicable subheading for both of the above mentioned samples will be 3926.40.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics and articles of other materials of headings 3901 to 3914: statuettes and other ornamental articles. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
