RE: The tariff classification of hair accessories from Korea.

Dear Ms. Barr:

In your letter dated July 30, 1999, on behalf of Lane Bryant, a division of The Limited, Inc., you requested a tariff classification ruling.

The following samples were submitted with your request:

1. Style Number 6183 is a set of hair accessories consisting of two bobby pins and one claw clip. The bobby pins are made of tin and each has a dragonfly made of glass and tin attached to it. The claw clip is made of tin and has a butterfly made of glass and tin attached to it.

2. Style number 6184 is a set of hair accessories consisting of two bobby pins and one barrette. The bobby pins are made of tin and each has a daisy made of enamel, glass and tin attached to it. The barrette is made of tin and has a butterfly made of enamel, glass and tin attached to it.

Your samples are being returned as requested.

We consider both style numbers to be a set without an essential character. Therefore, based on Rule 3(c) of the General Rules of Interpretation (GRI) of the Harmonized Tariff Schedule of the United States (HTS), the sets will be classified under the heading which occurs last in numerical order among those which equally merit consideration. In this instance, the heading for the bobby pins occurs last.

The applicable subheading for the hair accessory sets will be 9615.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for combs, hair-slides and the like; hairpins, curling pins, curling grips, hair-curlers and the like, other than those of heading 8516, and parts thereof. The rate of duty will be 11% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
