RE: The tariff classification of women's upper body garments from Hong Kong

Dear Mr. Hoffacker:

This letter replaces binding ruling PD E84271 dated July 22, 1999, which incorrectly referred to the two garment styles in the first paragraph.

In your letter dated June 30, 1999, you requested a tariff classification ruling on behalf of Leonard A. Feinberg Incorporated.

Two samples of women's garments, Style #s LAF029 and 622, were submitted. Both garments are composed of 100% cotton finely knit fabric. Style # LAF029 is a women’s tank-styled pullover featuring a scooped neckline; capping around the armholes and upper edge which extends to form straps; a patch pocket located at the bottom and having entry on two sides; and a drawstring bottom. Style #622 is a tank-styled top which simulates one top worn under another top. The two upper portions are attached to each other and the bottom of the front panel immediately below the bust. Other features include capping around the upper edges which extend to form straps on both upper sections; rear upper edges which extend straight across from side seam to side seam; and a hemmed bottom. Per your request, your samples are returned herewith.

The applicable subheading for Style #LAF029 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for pullovers, of cotton, other, other, other, women's or girls'. The rate of duty will be 18.6 percent ad valorem. The applicable subheading for Style #622 will be 6114.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of cotton: tops: women's or girls'. The rate of duty will be 11.2 percent ad valorem.

Style #s LAF029 and 622 fall within textile category designation 339. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
