RE: The tariff classification of printed circuit assemblies from China

Dear Ms. Castillo:

In your letter dated May 3, 1999, you requested a tariff classification ruling on behalf of Advance Fibre Communications of Petaluma, California.

The merchandise is described in your letter and submitted literature as printed circuit assemblies for the Universal Modular Carrier (UMC) System 1000. The UMC 1000 is a Digital Loop Carrier System designed to provide telephone subscriber services.

This particular request covers five printed circuit assemblies:

· LI-APOTS - Local Exchange International Advanced POTS Channel Unit provides six-trunk terminating loop start “ Plain Old Telephone Service” circuits. It has reverse battery detection and pulse metering for special POTS applications requiring these capabilities. It provides loop-start only signaling with ring cadence following, on-hook transmission, forward disconnect and pulse metering. It also has Caller ID feature.

· RI-APOTS - Remote Subscriber International Advanced POTS Channel Unit provides six two-wire circuits of standard loop start “Plain Old Telephone Service” per unit and provides ring cadence. Its other features include pulse metering, transient protection for outdoor bridging, Caller ID, reverse battery detection, on-hook transmission and forward disconnect which is optional.

· LI – BPOTS - Local exchange International Basic POTS Channel Unit provides six trunk terminating loop start “Plain Old Telephone Service” (POTS) circuits. It provides loop start only signaling with ring cadence following, on-hook transmission between ring bursts. It also provides a high on-hook DC resistance as well as a universal-ringing detector and has two LED indicators.

· RI – BPOTS - Remote Subscriber International Basic POTS Channel Unit provides six circuits of standard loop start “Plain Old Telephone Service” (POTS). It is the Remote Subscriber Terminal (RST) loop start counterpart to the loop terminating LI-BPOTS Channel Unit. It provides ring cadence following, local ring trip and on-hook transmission between ring – bursts.

· R – EPOTS - RST Extended Range POTS Channel Unit provides long loop length Plain Old Telephone Service (POTS) service for rural POTS applications. It provides ring cadence following, local ring trip, on-hook transmission between ring-bursts and forward disconnect. It features integrated transmit and receive gain adjustment and may be used with either loaded or non-loaded cable.

The applicable subheading for the LI-APOTS, RI-APOTS, LI-BPOTS, RI-BPOTS and R-EPOTS printed circuit assemblies will be 8517.90.3600, Tariff Schedule of the United States (HTS), which provides for “Electrical apparatus for line telephony or line telegraphy  Parts: Other: Printed circuit assemblies: For telephonic apparatus: For switching or terminal apparatus (other than telephone sets).” The rate of duty will be 2.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
