RE: The tariff classification of handbags from China.

Dear Mr. Simon:

In your letter dated April 8, 1999, on behalf of Accessory Network Group, Inc., you requested a classification ruling.

The two samples submitted with your request are identified as follows: the first is identified as "Hide Out Pooh II," Style #U226265, the second as Style #U2331441/44. The bags are small children's packs designed to contain the small personal affects that a child would carry while traveling about on a daily basis.

Style #U226265 measures approximately 8 inches in height by 6 inches in width by 3 inches in depth. The bag has an external surface of woven fabric comprised of 55% ramie and 45% polyester. On the back of the bag, there is a carry strap and two permanently attached adjustable straps that enable use as a backpack. The bag has a zippered closure across the top and halfway down each side.

Style #U2331441/44 is constructed of an external surface of 100% woven polyester fabric. It measures approximately 8 inches in height by 6 1/2" in width by 3 inches in depth. On the front of the bag, there are two zippered pockets, one placed above the other. On the back of the bag, there is a carry strap and two permanently attached adjustable straps that enable use as a backpack. The bag has a zippered closure across the top and halfway down each side.

The applicable subheading for Style #U226265 will be 4202.22.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags¬with outer surface of textile materials, other, of vegetable fibers and not of pile or tufted construction, other. The duty rate will be 6.1% ad valorem.

The applicable subheading for Style #U2331441/44 will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags¬with outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 18.8% ad valorem.

HTS subheading 4202.22.6000 falls within textile category designation 871. Based upon international textile trade agreements products of China are subject to the requirement of a visa.

HTS subheading 4202.22.8050 falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.USTREAS.GOV. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
