RE: The tariff classification of Resimene 797 and Resimene 2040 from Canada.

Dear Ms. Pierce:

In your letter dated March 5, 1999, you requested a tariff classification ruling.

Based on the technical literature submitted, Resimene 797 is a resinous polyol modified methylated melamine-formaldehyde resin solution composed of approximately 72-76 percent methylated melamine-formaldehyde resin, 16-20 percent styrene-allyl alcohol resin, 6-10 percent ethanol and 0.2 percent formaldehyde, by weight. Resimene 2040 is a styrene-allyl alcohol modified methylated melamine-formaldehyde resin solution composed of approximately 83-87 percent methylated melamine-formaldehyde resin, 13-17 percent ethanol and 0.15 percent formaldehyde, by weight.

The applicable subheading for the Resimene 797 and Resimene 2040 will be 3909.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Amino-resins, phenolic resins and polyurethanes, in primary form: Melamine resins. The rate of duty will be 6.5 percent ad valorem.
