RE: The tariff classification of CD cases from China.

Dear Mr. Startare:

In your letter dated February 24, 1999, on behalf of Computer Expressions, Inc., you requested a classification ruling for CD cases.

You have submitted four samples, no style numbers indicated, which are compact disk carrying cases manufactured with an exterior surface of plastic and/or leather. You have indicated that the plastic sleeves (not included) to contain the compact disks are U.S. made and are assembled in the U.S. The cases are secured by means of hook and loop fasteners and/or zippered closures.

The applicable subheading for the compact disk cases of plastic will be 4202.92.9050, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcase..., and similar containers, with outer surface of textile materials, other, cases designed to protect and transport compact disks (CD=s), CD ROM disks, CD players and/or cassettes. The duty rate will be 18.8 percent ad valorem.

The applicable subheading for the compact disk cases of leather will be 4202.91.0090, HTS, which provides for trunks, suitcases..., and similar containers, other, with outer surface of leather, of composition leather or of patent leather, other. The duty rate will be 4.5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
