RE: The tariff classification of a baseball with a plastic clip attached.

Dear Ms. Kelly-Kobayashi:

In your letter dated February 25, 1999, you requested a tariff classification ruling in behalf of your client, Gund, Inc., 1 Runyons Lane, Edison, New Jersey, 08818, for a baseball with a plastic hook attached.

A prototype of the imported article has been submitted and assigned the working style No. M0616.

The article will be made in either China or Hong Kong.

The baseball is approximately 1 3/4" in diameter and will be composed of either vinyl or tricot with a polyester fiber filling and the outer surface will be screened printed with various team logos. A plastic clip or hook will be attached to the baseball by means of a satin ribbon.

The plastic clip will be used to attach the ball to a knapsack or belt loop. The clip is too wide to be capable of holding a key.

Your sample is being returned under separate cover.

The applicable subheading for the baseball with a plastic clip attached will be 9503.90.0045, Harmonized Tariff Schedule of the United States (HTS), which provides for Other toys;..... Other: Other toys ..... The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
