RE: The tariff classification of craft items from China

Dear Mr. Maher:

In your letter dated February 17, 1999, you requested a classification ruling on behalf of Roseart Industries.

Style # ASB-4431, the Supha Busy Box Set, consists of four bags containing the following: 1) 100 percent polyvinyl chloride lanyards measuring under 5mm in width and 5 yards in length, packaged five pieces to a polybag. 2) A bag of pom poms of assorted sizes and colors. They do not have any attachments to them. The appear to be made of man-made fibers. 3) A bag of dyed feathers. They are loosely packed and do not have anything attached to them. 4) A bag of base metal clasps for attachment to zippers.

The applicable subheading for the lanyards will be 5404.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for synthetic monofilament..strip and the like (for example, artificial straw) of synthetic textile materials of an apparent width not exceeding 5mm, other. The duty rate will be 2.6 percent ad valorem.

The applicable subheading for the pom poms will be 5808.90.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for braids in the piece, ornamental trimmings in the piece...tassels, pom poms and similar articles: other, of man-made fibers. The duty rate will be 5.8 percent ad valorem.

The applicable subheading for the feathers will be 6701.00.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for skins and other parts of birds with their feathers or down, feathers, other. The duty rate will be 4.7 percent ad valorem.

The applicable subheading for the metal clasps will be 8308.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for clasps, frames with clasps, buckles...and the like...of base metal...other, other. The duty rate will be 2.7 percent ad valorem.

Pom poms falls within textile category designation 229. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
