RE: The tariff classification of three toy sets manufactured in China.

Dear Ms. Bartlett:

In your letter dated January 28, 1999, you requested a tariff classification ruling on behalf of TMP International Inc., 15155 Fogg Street, Plymouth, MI 48170.

You provided a sample of the following sets:

Sniper Wolf, Item # 18106- This set consists of a 6 inch human woman dressed in a grey uniform, black boots and gloves. Included in the set is a 4 X 1 2 inch grey wolf and a rifle.

Ninja, Item # 18107- Included is a 6 2 male human figure dressed in a grey and brown uniform and wearing a silver helmet. Included is a sword, a space gun and an extra closed helmet.

Psycho Mantis, Item # 18108- The set includes a 6 2 inch figure dressed in a grey sleeveless uniform with black boots and straps. The hairless head appears to be similar to a human skull with skin sewn and stretched tightly. On the back of the skull is a black cap with straps connecting to electrodes attached to five different locations on the skull. Included in the set is a vase, column, bust, ball and gas mask.

All of the figures articulate to various degrees and are packaged for retail sale is blister packages printed with the name of the set and the bold wording ATactical Espionage Action Metal Gear Solid.@

The applicable subheading for Item # 18106 and Item # 18107 is 9502.10.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for Dolls representing only human beings and part and accessories thereof: Dolls, whether or not dressed, Other. This classification is free of duty.

The applicable subheading for Item # 18108 is 9503.49.0025, Harmonized Tariff Schedule of the United States (HTS), which provides for Other toys; models and similar recreational models, working or not; ...,Toys representing animals or non-human creatures ..., other, toys. This classification is free of duty.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
