RE: The tariff classification of a cellular phone case from China.

Dear Mr. Epstein:

In your letter dated January 12, 1999, you requested a classification ruling on behalf of your client, Avon Products, Inc., 1251 Avenue of the Americas, New York, NY

The submitted sample, Cellular Phone Holder - PP 187733, is a cellular phone holder with an outer surface comprised of 100 % PVC material. This item has a zippered compartment containing a zippered coin pocket, pen loop, business card window and five credit card slots. It has a velcro type flap closure across its top. The exterior of the cellular phone holder has a belt loop with a snap closure and a removable carrying strap. Your sample will be returned to you as requested.

The applicable subheading for the cellular phone holder , #PP 187733, will be 4202.92.9060, Harmonized Tariff Schedule of the United States Annotated, which provides for trunks, suitcases, traveling bags and similar containers, with outer surface of plastic sheeting, other, other, other. The duty rate will be 18.8% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations.

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
