RE: The tariff classification of rayon door hangers from India.

Dear Mr. Reichert:

In your undated letter, received in this office on August 11, 1997, you requested a classification ruling.

You have submitted three samples of door knob hangers. The items are described as “velvet mini pillow pals.” They are made of stuffed rayon plush fabric and are about 5 inches square. Each door knob hanger has a rayon loop for hanging. Each has a decorative message or motif embroidered on the front panel in metallic thread.

SKU# 89670 has “Do Not Disturb” embroidered on the front. SKU# 88230 has “Happy Holidays” embroidered on the front and Vendor item #40927 has a bell motif embroidered on the front. SKU# 88230 also has a rayon tassel hanging from the bottom of the door hanger.

The applicable subheading for the SKU# 89670 (Do Not Disturb) and Vendor item # 40927 (the bell motif) will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles (of textile fabric), other, other, other. The duty rate will be 7 percent ad valorem.

The applicable subheading for the SKU# 88230 (Happy Holidays) will be 9505.10.2500, HTS, which provides for articles for Christmas festivities and parts and accessories thereof, Christmas ornaments, other. The duty rate will be free.

Articles which are classifiable under subheading 6307.90.9989, HTS, which are products of India are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
