RE: The tariff classification of a ceramic cup from China.

Dear Ms. Keiger:

In your letter dated October 6, 1998, on behalf of Central Ceramic Supply, you requested a tariff classification ruling.

The sample submitted is a barrel-shaped ceramic cup of stoneware with looped handle which measures approximately 2 3/8 inches in height with an open top diameter of 3 inches. It is stated to be valued over $5.25 per dozen.

The applicable subheading for this ceramic cup will be 6912.00.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for other ceramic tableware...other than of porcelain or china...cups valued over $5.25 per dozen. The rate of duty will be 4.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
