RE: The tariff classification of women's woven man-made fiber blouse and other garment from China

Dear Mr. Zeitlin:

In your letter dated February 13, 1998 you requested a tariff classification ruling on behalf of your client, Karen Stevens Inc. Your sample will be returned as you requested.

The submitted sample, StyleP22469DL-2, consists of two garments. The first item is a blouse and is composed of 70% rayon, 30% polyester woven fabric. The second piece, which your refer to as a liner, is constructed of a 100% acetate on the top with a 70% rayon, 30% polyester woven bottom portion. The blouse features a round neckline, a back zipper closure, short hemmed sleeves, shoulder pads, ten decorative covered buttons down the center front, soutache and pearl like beading trim across the front, a front center slit and a hemmed bottom. The second piece, which you refer to as a liner, extends from the shoulders to the knee area. It is sleeveless and has oversized armholes, a front closure secured by four buttons and two hook and eyes, and a hemmed bottom.

The applicable subheading for the blouse will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women's. The rate of duty will be 27.9%.

The applicable subheading for the other garment will be 6211.43.0091, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, women's or girls': of man-made fibers: other. The rate of duty will be 16.6%.

Style P22469DL-2 falls within textile category designation 641 for the blouse portion and 659 for the other portion. Based upon international textile trade agreements, products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
