RE: The tariff classification of Travel Bags from Indonesia and China

Dear Ms. Keith:

In your letter dated February 4, 1998, you requested a tariff classification ruling on behalf of our client Mabis Healthcare, Inc., 28690 N. Ballard Drive, Lake Forest, IL 60045.

Style No. 11551 is a PVC padded utility shopper type tote measuring approximately 11 1/2 inches in length x 9 1/2 in width x 5 1/2 in depth. The bag has a zippered closure and straps on each side.

Style Nos. 11557 and 46412 are travel bags of man-made textile fibers. Style No. 11557 measures approximately 11 inches in length x 19 inches in width x 5 inches in depth. An outer compartment extents the width of the bag with a snap closure. In addition, there are shoulder straps and a zippered top closure. Style No. 46412 measures approximately 9 inches in length x 13 inches in width x 7 1/2 inches in depth. The sample has the resemblance of a yellow school bus.

The applicable subheading for the Style No. 11551, padded utility shopper tote will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags with an outer surface of a sheeting of plastic, other. The rate of duty will be 20 percent ad valorem.

The applicable subheading for Style Nos. 11557 and 46412, travel bags will be 4202.92.3030, Harmonized Tariff Schedule of the United states (HTS), which provides for travel, sports and similar bags with an outer surface of textile materials, of man-made fibers, other, other. The rate of duty will be 19 percent ad valorem.

Items classifiable under 4202.92.3030 fall within textile category designation 670. Based upon international textile trade agreements, products of Indonesia and China are subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
