RE: The tariff classification of a large zippered top travel tote bag having an outer surface of thin clear plastic sheeting laminated over a textile fabric of woven plastic strips less than 5 millimeters is width from China

Dear Mr. Satz:

In your letter dated December 31, 1997 you requested a tariff classification ruling on behalf of your client, Lollipop Import & Export of Brooklyn, Incorporated.

The item which Lollipop Import & Export intends to import is a large zippered top travel tote bag measuring approximately 21 x 11 x 26 inches. The bag is made from woven textile fabric made from plastic strips under five millimeters in width which has been laminated on its outward facing side as it is used in the bag with a thin clear layer of plastic sheeting. It has two carry handles made from the same material.

The applicable subheading for the travel tote bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
