RE: The tariff classification of a tension fastener from China.

Dear Mr. Zupito:

In your letter dated December 8, 1997, you requested, on behalf of your client, Sales Systems Limited, a tariff classification ruling.

You described the merchandise as a tension nut (P/N 4A2148500) and tension screw (P/N 15266200). You state they were designed to be used as a tightening mechanism in office seats and cannot be used for any other purpose. They will be imported together, however, they may at times be imported as individual items.

The tension screw is made of C1018 steel. It is approximately four inches in length, 8 mm in diameter and threaded just over half way up the shank with a cross drilled hole located in the lower portion of the threaded shank. This tension screw has the design characteristics of a bent bolt with a right angle bend. The tension nut is a steel beveled block of approximately one inch by one inch square, 3 mm thick, with a threaded hole in the center.

The applicable subheading for the tension screw and tension nut, imported as a unit, as well as the tension screw, imported by itself, will be 7318.15.2040, Harmonized Tariff Schedule of the United States (HTS), which provides for Screws, bolts, nuts . . . and similar articles, of iron or steel: Threaded articles: Other screws and bolts, whether or not with their nuts or washers: Bolts and bolts and their nuts or washers entered or exported in the same shipment having shanks or threads with a diameter of 6 mm or more: Bent bolts. The rate of duty will be 0.3 percent ad valorem. As of January 1, 1998 the rate of duty will be 0.1 per cent ad valorem. If the tension nut is imported separately from the tension screw, the applicable subheading for the tension nut will be 7318.16.0085, HTS, which provides for Screws, bolts, nuts . . . and similar articles, of iron or steel: Threaded articles: Nuts, Other: Other. The rate of duty will be 0.1 percent ad valorem. As of January 1, 1998 the rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
