RE: The tariff classification of a cutting machine from Belgium

Dear Ms. Edick:

In your letter dated September 8, 1997 you requested a tariff classification ruling.

With your inquiry you submitted descriptive literature on the Grafityp CSR-700 and samples of plastic materials used with this machine. The Grafityp CSR-700 is used to cut letters, numbers, and graphic designs into vinyl, sandblast stencil, paper, and other film materials. It incorporates rollers and continuously adjustable sprockets to feed the material, a tangential knife, four precision controlled stepper motors, and a computer interface. The CSR-700 is 16.5 inches high, 20 inches deep, 40.5 inches long, and weighs 143 pounds.

The applicable subheading for the Grafityp CSR-700 will be 8477.80.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other machinery for working rubber or plastics or for the manufacture of products from these materials, not specified or included elsewhere (in chapter 84). The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Alan Horowitz at 212-466-5494.
