RE: The tariff classification of pot roast dinners from Uruguay.

Dear Ms. Valerio:

In your letter, dated September 11, 1997, you have requested a tariff classification ruling.

The product is a pot roast dinner. The ingredients are 28.6 percent frozen, cooked beef, 28.6 percent potatoes, 25.09 percent beef stock, 5.72 percent carrots, 5.72 percent celery, 2.85 percent beef extract, 1.6 percent modified food starch, 1.16 percent onions, 0.3 percent salt, 0.21 percent beef fat, 0.07 percent black pepper, and 0.07 percent dehydrated garlic. The packing includes two wrappings - a skin pack to provide a hermetic seal, and a standard shrink film to secure the label and provide additional protection. The net weight is 40 ounces or 1134 grams.

The applicable subheading for the pot roast dinner will be 1602.50.9020, Harmonized Tariff Schedule of the United States (HTS), which provides other prepared or preserved meat, meat offal or blood, of bovine animals, other, other, prepared meals. The rate of duty will be 6.2 percent ad valorem.

Articles classifiable under subheading 1602.50.9020, HTS, which are products of Uruguay, are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
