RE: The tariff classification of unisex scrub pants and shirts from Honduras.

Dear Mr. Hart:

In your letter dated August 18, 1997, on behalf of Selmer Apparel, you requested a classification ruling.

You have submitted a brochure featuring scrub pants and shirts. Style 7618 consists of lightweight scrub pants with a drawstring closure and a right back hip pocket which you state consists of 50% polyester/ 50% cotton. Style 7518 is a lightweight economical v-neck scrub top with set in sleeves and one chest pocket which you state to consist of 50% polyester/50% cotton. Style 8232 is a V-neck tunic with a dolman style sleeves, side vents and snap front closure. Two patch pockets with scissor tape in the right pocket consisting of 65%/35% combed cotton poplin with soil release finish. Style 8312 Women's pant, with one-inch multi-stitched covered elastic waistband, and tapered leg consisting of 65%/35% combed cotton poplin with soil-release finish.

Styles 7618 and 7518 are to be constructed of a 50/50 blend of fibers. Even a slight change in the fiber content may result in a change of classification, as well as, visa and quota requirements. The items may be subject to U.S. Customs laboratory analysis at the time of import and if the fabric is other than 50/50 blend it may be reclassified by Customs at that time.

The applicable subheading for the Style 7618 will be 6204.63.3510, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of synthetic fibers: Other: Other, Trousers and breeches: Women's. The duty rate will be 29.9% ad valorem.

The applicable subheading for the style 7518 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' blouses, shirts and shirtblouses: Of man-made fibers: Other: Other: Women's. The duty rate will be 28.1% ad valorem.

The applicable subheading for style 8232 will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls blouses,...: Of cotton: Other, Other: Women's. The duty rate will be 16.1% ad valorem.

The applicable subheading for style 8312 will be 6204.62.4020, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of cotton: Other: Other: Other, Trousers and breeches: Women's: Other. The duty rate will be 17.4% ad valorem.

Style 7618 falls within textile category designation 648. Style 7518 falls textile category 641 and style 8232 falls within 341. Style 8312 falls within textile category 348. Based upon international textile trade agreements products of Honduras are "not" subject to quota and the requirement of a visa.

The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
