RE: The tariff classification of a cosmetic bag from Taiwan.

Dear Ms. Balice:

In your letter dated February 19, 1997, you requested a tariff classification ruling.

The sample submitted with your request, style 36152, is a cosmetic bag approximately 6" x 4 1/2" in size. The interior is undivided and lined on one side with a polyester fabric. This bag has a zipper closure. The exterior of the bag is composed of two materials, a textile backed PVC and an acrylic textile fabric. One side is textile fabric while the other side and bottom is textile backed PVC. The outer surface of style 36152, note GRI 3(c), is of sheeting of plastic.

The applicable subheading for style 36152 will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, other. The rate of duty will be 20 per cent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs Officer handling the transaction.
