RE: The tariff classification of portfolio from China

Dear Mr. Jones:

In your letter dated May 6, 1996 you requested a tariff classification ruling. Your request is on behalf of Cetco International.

A sample of a portfolio type carrying case manufactured of an outer surface of imitation leather with a removable presentation system has been submitted. The portfolio has a zipper closure on three sides and is carried by means of double top carrying handles or a removable shoulder strap. The exterior has a full size storage compartment on each side. The interior is fitted with pen holders, utility pockets and a mesh storage pouch on one interior side. The opposite side is fitted with a removable system of clear polypropylene files each of which are snapped together so that they can be removed individually or hung for display as a unit by means of an attached hanger. The concept of the portfolio and files is that of a complete presentation system.

The applicable subheading for the entire article, carrying case with presentation files, will be 4202.12.2035, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for attache cases, briefcases, occupational luggage cases, and similar containers, with outer surface of plastics, other. The rate of duty will be 20 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
