RE: The tariff classification of bicycle repair tools from Taiwan.

Dear Mr. Todrys:

In your letter dated July 22, 1997, you requested a tariff classification ruling.

The subject items are described as follows:
a) #T1332 Alien 20 Function Multi Tool - 20 tools fold into a glass reinforce nylon body for easy carrying. Tools include: allen wrenches, box wrenches, phillips and flat head screwdriver, a universal chain tool, spoke wrenches, tire levers, a steel knife and a bottle opener.
b) #T2100 Power 21 Tool - contains allen wrenches, box wrenches, flat head screwdriver, universal chain tool, spoke wrenches, combo "T" wrench, chain hook, and a tire lever.
c) #C9301 Survival Gear Box - 14 function tool containing 8 combo wrenches, chain tool, 2 tire levers, patch glue/kit and a leverage bar.
d) #T1500 MK-2 Emergency Tool Kit - contains combo allen keys, chain exactor, chain hook, tire levers, glue and patches.

Item a is a composite article that prima facie appears to be classifiable under more than one heading, each equally specific. Classification will accordingly be determined on the basis of that portion of the article which imparts the essential character. We have concluded that there is no essential character for this composite article.

Therefore, it shall be classified under the heading which occurs last in numerical order among those which equally merit
consideration. In this instance, the knife classification is last.

The applicable subheading for item a, the Alien 20 tool, will be 8211.93.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for knives having other than fixed blades. The duty rate will be 3 cents each + 5.4% ad valorem.

Items b, c and d are considered composite goods, consisting of different materials or made up of different components. These items shall be classified as if it consisted of the material or component which gives it its essential character. In each of the 3 instances, the wrenches impart the essential character.

The applicable subheading for items b, c and d will be 8204.11.0060, HTS, which provides for hand-operated spanners and wrenches, and parts thereof: nonadjustable, and parts thereof: other. The duty rate will be 9% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
