RE: The tariff classification of a playmat and PVC travel bag from Hong Kong

Dear Ms. Lane:

In your letter dated July 8, 1997 you requested a tariff classification ruling.

A sample of the "Carters Stuffed Animal Travel Playmat", item #2433, was not available, however, you submitted a very similar model which is acceptable for classification purposes. The product consists of a quilted playmat, two bendable rods, three rattle and ring toy features, and a PVC carry bag. The quilted playmat is made of cotton/polycotton materials and measures 36" X 37". The quilt has sewn in activities including a mirror, rattles and textured fabrics. The bendable rods form a dome style, criss-cross pattern, when attached to the quilt via a plastic, seat belt type, locking system. Rattles and rings are suspended from the rods to encourage a child's sensory development. The clear PVC travel bag has a snap closure and carry handle for ease in portability of the playmat unit. All components are imported and sold within a closed box for retail sale.

The item does not constitute a set for tariff classification purposes and, therefore, is separately classifiable. Your sample is being returned as requested.

The applicable subheading for the playmat with rods, rattles and rings, will be 9503.90.0045, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys: other: other toys and models. The rate of duty will be free.

The applicable subheading for the PVC travel bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic or of textile materials, other. The rate of duty will be 20 percent ad valorem.

At this time articles classified in HTS 9503.90.0045 and HTS 4202.92.4500 are not subject to quota restraints or visa requirements.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
