RE: The tariff classification of food products from Canada

Dear Mr. Le Gal:

In your letter dated June 10, 1997 you requested a tariff classification ruling.

Samples and product labels accompanied your letter. The samples were examined and disposed of. Chokecherry Jelly is a dark red, gelatinous product, said to be composed of 50 percent chokecherry juice, 49 percent sugar, and one percent pectin. Cloudberry Compote consists of yellow berries, most in whole condition, in a thick, yellow syrup. Marinated Cattail Hearts consists of ivory-colored rods, approximately two inches long, and round or oval in cross-section, in a clear liquid solution composed of water, lemon juice, and salt. All are packed in round glass jars containing 500 milliliters (16 fluid ounces).

The applicable subheading for the Chokecherry Jelly will be 2007.99.7500, Harmonized Tariff Schedule of the United States (HTS), which provides for fruit jellies...other. The duty rate will be 5.1 percent ad valorem.

The applicable subheading for the Cloudberry Compote will be 2008.99.2000 HTS, which provides for fruit...otherwise prepared or preserved...other...berries...other. The rate of duty will be 5.8 percent ad valorem.

The applicable subheading for the Marinated Cattail Hearts will be 2008.99.9090, HTS, which provides for other edible parts of plants, otherwise prepared or preserved...other...other... other. The rate of duty will be 6.5 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the Saskatoon Berry Preserves and the Pickled Milkweed Pods. The samples of these two products were received in damaged condition and could not be examined. Please resubmit samples of these articles.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
