RE: The tariff classification of Town Square Building accessory figure from China.

Dear Ms. Smith:

In your letter dated June 18, 1997, you requested a tariff classification ruling.

The submitted sample is identified as stock no. 98970, Conductor. The conductor is dressed in a grey suit, red vest and red tie, with a black hat and black shoes. The figure appears to be standing in the snow. He is holding a Coca-Cola bottle in one hand while he checks his pocket watch. This item is designed with a base that enables the figure to be placed on a table for decorations. Your letter of inquiry states that this item will be used as an accessory in conjunction with the Town Square Building Collection.

The sample is returned as requested.

The applicable subheading for the conductor figure will be 9505.10.5020, Harmonized Tariff Schedule of the United States (HTS), which provides for festive...articles for Christmas festivities and parts and accessories thereof, other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
