RE: The tariff classification of decorative articles made of plastic ribbons, from China.

Dear Ms. Aldinger:

In your letter dated May 27, 1997, you requested a tariff classification ruling.

A sample identified as "Curl Swirls" (item #972738) was submitted and will be retained for reference. It is a bundle of 12 curly plastic ribbons (approximately 15 inches long), stapled in the center to a 2 x 3/4 inch slip of self-adhesive plastic. The ribbons, which individually measure about 6 1/2 mm in width, are thin, flexible strips of polypropylene or similar plastic, colored (and possibly metallized) to three different hues. (There are four each of red, gold and emerald.) The product is intended for use as a stick-on decoration or adornment for packages or other objects during the Christmas season.

The applicable subheading for the "Curl Swirls" will be 4602.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) articles of plaiting materials. The rate of duty will be 4.2%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
