RE: The tariff classification of a woman's knit ensemble from Bangladesh

Dear Mr. Stein:

In your letter dated March 21, 1997, on behalf of Morsly, Inc., you requested a tariff classification ruling.

The submitted sample, style 7504, is a two-piece woman's ensemble constructed from 100% polyester finely knit fabric napped on the inner surface. Both components are of identical fabric construction, color, style and composition and are of corresponding size.

The upper component is a knit sweater-like cardigan which features a full frontal opening with five button closures, a collar, long sleeves with ribbed knit cuffs, a left chest patch pocket, and a straight hemmed bottom with 2" side slits. The lower component is a pair of ankle-length trousers with an elasticized waist, side seam pockets, and straight hemmed bottoms.

Your sample will be returned as requested.

The applicable subheading for the cardigan will be 6110.23.0036, Harmonized Tariff Schedule of the United States (HTS), which provides for women's ensembles: of synthetic fibers...blouses, shirts, and tops. The rate of duty will be 33.5% ad valorem. This is the rate which would apply if the garments were entered separately and classified subheading 6110.30.3055.

The applicable subheading for the trousers will be 6104.23.0032, HTS, which provides for women's ensembles: of synthetic fibers...trousers and breeches. The rate of duty will be 29.5% ad valorem. The is the rate which would apply if the garments were entered separately and classified in subheading 6104.62.2011.

The cardigan falls within textile category designation 639. The trousers fall within textile category designation 648. As a product of Bangladesh, this merchandise is subject to a visa requirement and quota restraints based upon international textile trade agreements.

The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
