RE: The tariff classification of women's wool boiled knit suit-type jacket and woven linen divided skirt from Hong Kong

Dear Ms. Zink:

In your letter dated November 11, 1996, you requested a classification ruling.

Style 74076456/74076456p is a woman's 100% wool boiled knit suit-type jacket constructed with more than nine stitches per two centimeters measured in the horizontal direction. The unlined garment extends below the waist and features a pointed collar; a full frontal opening with six decorative metal button closures; shoulder pads; patch pockets below the waist; and long sleeves without cuffs. The collar, pocket openings, sleeve endings and bottom are finished with decorative yarn.

Style 72078229/72078229p is a woman's woven 100% linen divided skirt which extends to mid thigh and features a front panel which completely conceals the leg separation; onseam pockets; and a hemmed bottom.

The applicable subheading for the suit-type jacket will be 6104.31.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for suit-type jackets and blazers: of wool or fine animal hair. The duty rate will be 65.6 cents per kilogram plus 19.2 percent ad valorem.

The applicable subheading for the divided skirt will be 6204.59.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for skirts and divided skirts: of other textile materials: other, other: other. The duty rate will be 7.1 percent ad valorem.

Style 74076456/74076456p falls within textile category designation 435 and style 72078229/72078229p falls within textile category designation 842. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa.

As requested, the samples will be returned.
