RE: The tariff classification of hammered steel tubing and patterned steel material from Mexico.

Dear Ms. Cantu:

In your letter dated September 29, 1996 on behalf of New Metals, Inc., you requested a tariff classification ruling. Descriptive literature was submitted with your ruling request.

The products to be imported are described as hammered tubing and patterned material. The hammered tubing, made from Grades 1006 and 1008 carbon steel, is welded square tubing. A series of indentations have been hammered on all four edges of the tubes, giving them a decorative appearance. The tubes have outside dimensions of 1/2", 3/4", 1", 1 1/4", 1 1/2" and 2", wall thicknesses of 14, 16 and 18 gauge, and lengths of 24 feet. The patterned material is produced from carbon steel bar stock which has been embossed with various decorative motifs. The imported products are intended to be used as part of ornamental iron work assemblies for doors, pickets, gates, stair rails, etc. The applicable subheading for the square nonalloy steel tubing will be 7306.60.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other tubes, pipes and hollow profiles (for example, open seamed or welded, riveted or similarly closed), of iron or steel, other, welded, of noncircular cross section, having a wall thickness of less than 4 mm, of iron or nonalloy steel. The general rate of duty will be 6.4 percent ad valorem.

The applicable subheading for the patterned nonalloy steel material will be 8306.29.0000, HTS, which provides for statuettes
and other ornaments, of base metal, other. The general rate of duty will be 3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
